Planning permission had been granted for a replacement dwelling on the site, with a subsequent amendment (a Section 73) application to vary some elements of the design and layout

Whilst some of the conditions on the first consent had been discharged, conditions on the second consent remained underdetermined.  Demolition of the existing house had taken place but there was uncertainty as to which scheme had been implemented, whether implementation had been carried out before the relevant permission lapsed and whether the implementation was lawful.  There was concern that both consents had been lost.

Stansgate Planning submitted an application for a certificate of lawfulness presenting the case that the preferred scheme (the revised application submitted under Section 73) had been lawfully implemented and that the new house could be completed on the site.  With only a simple request for some additional photographs, Vale of White Horse District Council granted the certificate within 8 weeks, enabling the client to put the site on the market, with the security of the certificate providing certainty for the buyer.
